3. Our Response to Notices

Upon receipt of a valid DMCA notice, we will:

• Review the notice for completeness and validity
• Remove or disable access to the allegedly infringing material
• Notify the party responsible for the material, where applicable
• Take appropriate action in accordance with the DMCA, which may include removal of the material and, in cases of repeat infringement, discontinuation of the relevant product listing

4. Counter-Notification

If you believe that material was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent containing:

1. Your physical or electronic signature.
2. Identification of the material that was removed and its location on the Site before removal.
3. A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., an appropriate judicial district) and that you will accept service of process from the person who filed the original DMCA notice.

Upon receipt of a valid counter-notification, we may reinstate the removed material in accordance with the DMCA’s requirements, unless the original complainant informs us that they have filed a court action seeking a court order to restrain the alleged infringer.

5. Repeat Infringers

We reserve the right to terminate access for users who are determined to be repeat infringers of copyrighted material, in accordance with our obligations under the DMCA.

6. False Claims

Please note that submitting a false or bad-faith DMCA notice or counter-notification may result in liability for damages, including costs and attorneys’ fees, under Section 512(f) of the DMCA.
